The Mik's Hidden Hearts Alliance (MHHA) web site is a complimentary information service provided by MHHA as a convenience to users, with the express condition that users agree to be bound by the terms and conditions of this User Agreement. MHHA reserves the right to change the User Agreement terms and conditions at any time. Use of the MHHA web site constitutes your acceptance of the terms and conditions included below. 


Please note concerning our privacy policy:  The privacy of our hidden teens and their families is very important to us.  No information gathered will ever be sold or distributed.

You agree that you will hold harmless MHHAand its officers, directors, employees (if applicable), event venue, sponsors, donors and volunteers from all claims arising out of or related to your access or use of, or your inability to access or use, this web site or the information contained in this web site or other web sites to which it is linked. You also agree that MHHA or the contributors of information to this web site shall NOT be liable to you or anyone else for any decision made or action taken by you in reliance on information provided on the MHHA web site or for any consequential, special or similar damages, even if advised of the possibility of such damages.

Please carefully read the following terms and conditions relating to your participation any Mik's Hidden Hearts Alliance social, meeting and/or event 

which is conducted by MHHA and/or one of our sponsors. By attending one of our functions, you agree you are a legal adult or a legal guardian/parent to a minor child who wishes to participate at a MHHA function.  You (the ‘Attendee’ representing yourself and possible minor child) signify your acceptance of and obligation to the terms and conditions. If you have objections to the following Terms and Conditions, you should not register for or attend the Event.

 

Liability Waiver

While we take every possible measure to ensure Attendee safety at our functions, we can not control everything. For this reason, Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements: 


I, the willing Attendee (parent/guardian of minor child or Legal Adult) of MHHA function, hereby accept all risk to my health and of my injury or death that may result from participating in the Event and I hereby release MHHA and their officers, employees, interns, contractors, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Event, whether caused by negligence of MHHA, its 

governing board, officers, employees, or representatives, or otherwise. I further agree to indemnify and hold harmless MHHA and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Event. Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the Event, I consent to such treatment. I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of 

emergency medical treatment. I will notify MHHA verbally and in writing if I am at any time injured prior to, during, or after the Event in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that MHHA  is not legally obligated to act on that information in any way or to providing any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Event that I will notify MHHA and that the MHHA retains the right to ask that I not participate in portions of or the entirety of the Event.

 

Liability Disclaimer: No Professional Advice

The information contained in or made available by MHHA, or any third-party through the Event or their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal fields. MHHA does not offer any professional personal, medical, financial, or legal advice and none of the information contained in the Event should be confused as such advice.  To be clear: You, the Attendee, alone are responsible and accountable for your decisions, actions and results in life, and by your participation in our Event, you agree not to attempt to hold us, MHHA, liable for any decisions, actions or results that you make or experience in life due to your participation in this Event at any time, under any circumstance. 


Confidentiality and Non-Compete

Attendees may not use any device to video, photograph, or record any aspect of the Event without permission from MHHA first.  No other business or charity organization materials may be distributed at MHHA function without written permission from MHHA first.  No distributing a sign up sheet to get fellow families contact information is allowed without written permission from MHHA first.


Keep it Positive

MHHA main purpose is to bring joy and learning to look at difficult life situations in a positive light.  We encourage venting as long as the sole purpose is to determine positive solutions.  Doom and gloom conversations will not be allowed and should be redirected.  Parent/guardian concerns should be discussed with MHHA and/or fellow parent support group members outside the hearing of our youth.  


Photography

Photos will be taken at our events.  Photos will never be sold, but maybe used for future MHHA functions and/or awareness campaigns.  If you prefer not to have your or your minor child's pictures taken, we ask that you not attend due to the difficulties in excluding just a few from our event photos.  By attending our functions, you agree to the use of your and your minor child's photos.  Unless permission is granted, only first name and last name initial is used on the photos.

Jurisdiction

This Web site (excluding linked sites) is controlled by MHHA, which is headquartered in the Texas, USA.  It can be accessed from all 50 states, as well as from other locations around the world. Each of these locations have laws that may differ from those of Texas. Therefore, by accessing this web site both you and MHHA agree that the statutes and laws of the Texas, without regard to principles of conflicts of law in Texas or elsewhere, shall apply to all matters arising from or relating to use of this web site. You and MHHA also agree and hereby submit to the exclusive personal jurisdiction and venue of the state and/or federal courts located closest in proximity to the MHHA office in Houston, Texas should any matter arise related to MHHA.


Use of Web site Discussion Groups/Bulletin Boards

MHHA provides this website and associated discussion groups/bulletin boards - including on Facebook - for the benefit of its members and the public. MHHA cannot and does not review all the information from or communications by users of the bulletin boards. MHHA expressly disclaims responsibility for and liabilities resulting from, any information or communications from and between users of the MHHA bulletin board.


The MHHA discussion groups (currently via Facebook) are forums for individuals to share their opinions, experiences and thoughts related to chronic illness. MHHA wants to ensure the integrity of this service and therefore, use of this service is limited to participants who agree to adhere to the following guidelines:


1. Refrain from transmitting any message, information, data, or text that is unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, that may be invasive of another's privacy, hateful, or bashing communications - especially those aimed at gender, race, color, sexual orientation, national origin, religious views or disability.


MHHA reserves the right to remove or edit a post containing offensive material as defined by MHHA. That stated, MHHA does not have the practical ability to restrict conduct or communications prior to transmission and posting, nor can MHHA ensure prompt editing or deletion of offensive posts.


MHHA reserves the right to remove or edit posts that contain controversial medical advice, explicit, obscene, offensive, or vulgar language. Similarly, posts that contain any graphic files will be removed immediately upon notice.


2. Refrain from posting or transmitting any unsolicited, promotional materials, "junk mail," "spam," "chain mail," "pyramid schemes" or any other form of solicitation. MHHA reserves the right to delete these posts immediately upon notice.


3. MHHA invites and encourages a healthy exchange of opinions. If you disagree with a participant's post or opinion and wish to challenge it, do so with respect. The real objective of the MHHA message board is to promote discussion and understanding, not to convince others that your opinion is "right." Name calling, insults, and personal attacks are not appropriate and will not be tolerated. MHHA will remove these posts immediately upon notice.


4. MHHA promotes privacy and encourages participants to keep personal information such as address and telephone number from being posted. Similarly, do not ask for personal information from other participants. Message board posts that request participants submit personal information to another party will be removed immediately upon notice unless these posts have been pre-approved by MHHA staff. This includes, but is not limited to, communications that ask for telephone, address, e-mail, surveys and research studies.


5. Participants should be aware that the opinions, beliefs and statements posted in this forum do not necessarily represent the opinions and beliefs of MHHA. Participants also agree that MHHA is not to be held liable for any loss or injury caused, in whole or in part, by sponsorship of this message board. 


Conduct


You agree that you are prohibited from using this site to commit fraudulent activities, violate any law, statute, ordinance or regulation. Furthermore, no communications passing through this site may be defamatory, libelous, unlawfully threatening or unlawfully harassing, obscene or contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. MHHA will take immediate action to prevent violators of this policy from using our site.


User Content Submissions


MHHA encourages you and other users to contribute content to this website including, without limitation, videos and textual narratives that share your stories of hope for teens with Dysautonomia and other life-changing chronic illnesses and associated comments thereto ("User Content"). When you view User Content and comments submitted by other users, keep in mind that such User Content may not necessarily represent your own view or the view of MHHA. While MHHA encourages User Content that is supportive and helpful, through your use of the Services, you may be exposed to User Content that you may find offensive, objectionable, harmful, inaccurate or deceptive. You assume all associated risks.


Your User Content

You understand that when you submit User Content, you are granting MHHA a license to display the User Content in connection with the Services or otherwise as set forth in these Terms, and, whether or not your User Content is published on the website, MHHA guarantees no confidentiality or anonymity with respect to your User Content unless clearly stated in writing from you. While you don't have to include your name, your likeness, or any other specific information in the User Content you submit, if your video or other User Content conveys your name, your likeness, (or other identifying information in the background of your video) you understand and agree that this information may be displayed on the MHHA website along with your User Content. Accordingly, please review your User Content carefully prior to submission to ensure it contains no information that you are not comfortable sharing. If your User Content is a video, you can disable access to that User Content by deleting it from your YouTube account. You retain all ownership rights in the User Content you submit. However, by submitting your User Content to the MHHA website, you grant MHA a worldwide, perpetual, irrevocable non-exclusive, royalty-free, sub-licensable through multiple tiers, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, commercialize, and otherwise exercise all rights in and to the User Content in any media formats and through any media channels now known or hereinafter invented or discovered for any purpose consistent with the mission and vision of MHHA. Such license includes all rights and permissions to reproduce your likeness, name and any other personal information that you choose to submit as a part of the User Content. You also grant each user of the Services a non-exclusive license to access your User Content through the Service, and to use, reproduce, distribute, display, link to and perform such User Content as permitted through the functionality of the Services and under these Terms of Use. MHHA reserves the right to monitor User Content and to remove or decline to post any User Content at any time, for any reason (or for no reason), without notice and at its sole discretion, including, without limitation, if it determines that User Content is inappropriate or fails to comply with these Terms. MHHA has no responsibility for the backup of any of any User Content or any lost data resulting from the use, operation or discontinuation of any aspect of the Services.


Submitted Materials

Unless specifically requested, MHHA does not wish to receive any confidential, proprietary, or trade secret information from you via the website (including via contact email made available on the website). Accordingly, if you send MHHA any information or creative works including, without limitation, idea submissions, suggestions, business plans, concepts or demos in any media including photographs, graphics, audiovisual media or other material ("Submitted Material") you grant MHHA a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive, and fully transferrable, assignable, and sub-licensable right and license to use, copy, reproduce, modify, adapt, print, publish, translate, create derivative works from, create collective works from, and distribute, perform, display, license and sublicense (through multiple levels) the Submitted Material in any media now known or hereinafter invented, including for commercial purposes. If you send MHHA any Submitted Material you also warrant that the Submitted Material is not confidential or secret and that the Submitted Material is owned entirely by you. If you send MHHA any Submitted Material you warrant that you have all rights necessary (including rights of privacy and rights of publicity) to authorize MHHA to use Submitted Material as permitted by the license in this Section.
